David Protein Bar hit with class-action lawsuit over calories and fat claims

The complaint was filed on Jan. 23 in the U. S. District Court for the Southern District of New York, brought by three individuals who say they bought the bars and relied on the stated nutrition information. As of 12: 35 PM ET on March 12, 2026, the allegations remain unproven in court, and the company has signaled it intends to fight them.
What the lawsuit claims about the David Protein Bar label
The complaint alleges that the bars contain “way more” calories and fat than the packaging states, challenging the marketing of a product positioned for health-conscious customers. The plaintiffs cite independent and third-party testing that used a method known as the Atwater factors and concluded the number of calories exceeded the amount listed on the label by as much as 83%, the lawsuit claims.
The same testing is also cited for fat content. The plaintiffs allege the fat content exceeds the label’s stated amount by as much as 400%.
On its website and labels, the company states its bars contain 150 calories, 28 grams of protein, and 0 grams of sugar.
The complaint points to U. S. Food and Drug Administration guidelines that say a product is misbranded if the “nutrient content of the composite is greater than 20% in excess of the value for that nutrient declared on the label. ”
Company response and the defendant named in the case
The lawsuit lists Linus Technologies as the main defendant. Linus Technologies is described as a nutrition-focused company founded by entrepreneur Peter Rahal in 2023, and it operates its business under the brand name David Protein.
Linus Technologies and David Protein did not immediately respond to a request for comment. On Wednesday, the company posted a statement on Instagram reading, “No one is getting Regina Georged, ” referencing the movie “Mean Girls, ” where a character is tricked into eating a protein bar linked to weight gain.
After the lawsuit was filed in January, Rahal said the company “stands behind the accuracy of our product labeling” and that it plans to “defend this claim vigorously. ”
