One witness, who testified under the pseudonym Katie Moore, told the court she was drugged and raped by Alon Alexander after a night out at a New York City club. She testified that after she was handed a drink, her “body started to sway, ” adding that the loss of control felt sudden rather than the gradual effect of drinking alcohol.

Moore testified that Alon and Tal Alexander made her and her friend leave the club, and she vaguely remembered getting into a cab. She said she later remembered “coming to” and being naked on a bed with Alon Alexander standing over her without clothes on. She testified that she tried to get out of bed, that she was pushed back down, and that when she said she did not want to have sex, she was told, “You already did. ”

Two additional women testified that they felt paralyzed before they were assaulted by Oren and Alon Alexander. Prosecutors also tied one of the charges against Oren Alexander to the alleged sexual exploitation of a minor, accusing him of filming and sharing a video of an incapacitated 17-year-old girl in April 2009. The woman, now 34, testified that she had no memory of meeting Oren Alexander.

Defense attacks credibility, argues sex was consensual

Defense attorneys sought to undermine accusers’ accounts, arguing some encounters were consensual and suggesting the women had financial motives. In closing arguments, Tal Alexander’s attorney, Deanna Paul, told jurors: “Financial interest is one of the most powerful motivators. All the stories were rehearsed. They’re looking for money. ”

Paul said the women met up with the brothers “willingly” and “were free to come and go. ” She also argued the government failed to prove an essential element, stating: “The government has not proved it was a commercial sex act because there wasn’t one, and they have failed to meet their burden. ”
